If your loan is for personal use, you are protected by responsible lending laws. Because of these protections, the recommendations given to you about your MTF loan are not regulated financial advice.

This means the duties and requirements imposed on people who give financial advice do not apply to these recommendations. This includes a duty to comply with a code of conduct and a requirement to be licensed.

As a responsible lender, MTF Finance will act with care and skill, both before and during the term of your loan.

Accuracy and Fraud

You must give us complete and truthful information. If details are missing or incorrect, we may decline your application or end your agreement. Giving false or misleading information is serious and can lead to legal consequences.

Credit Checks and Sharing Your Information

To process your application, we need to confirm your details and check your credit history. This may include:

• Verifying your identity and address and other information about you with trusted sources such as government agencies (for example, NZ Transport Authority, Department of Internal Affairs) and official registers like the Personal Property Securities Register (PPSR).
• Checking your credit history with Centrix and Equifax. We may share your information including repayment history with Centrix or Equifax and receive reports about your credit from them. These agencies may store your personal information and share it with others using credit reporting services. You have rights of access to, and correction of your credit information and any other personal information held by Centrix or Equifax. • Looking up overdue fines with the Ministry of Justice. If a credit reporting agency does this check for us, they will also see the results.
• Using your driver licence details (if provided) for identity checks with credit reporting agencies and the Ministry of Justice.
• Contacting other lenders you owe money to or anyone who has a legal claim over assets you plan to use as security for your loan.

By agreeing to these Application Terms, you agree to these checks and authorise any third party involved to share your information with us for these purposes.

Your Privacy and Data Handling

We respect your privacy and follow the Privacy Act 2020. We handle your personal information in line with our Privacy Statement and Privacy Policy.

We will take reasonable steps to ensure third parties receiving your data comply with equivalent privacy safeguards. You have the right to access and correct your personal information at any time.

Marketing Messages

We may send you messages about your loan and other products we offer. You may withdraw consent or opt out at any time from receiving marketing messages by following the instructions in our communications.

Sharing other’s information with us

You understand that if you share any personal information about another person (such as a guarantor), you confirm that the person has authorised the collection of their personal information by MTF Finance Group. You also confirm that you have informed that person of their rights to access and request correction of their personal information.

Your Agreement with us

These Terms form the entire agreement between you and us about your credit application. If any part of these Terms is found to be invalid, the rest will still apply. If these Terms conflict with the terms for a specific product or service, the product or service terms apply.

Proudly local

Our products and services are only for people residing in New Zealand and we follow New Zealand law. Any disputes will be handled exclusively by New Zealand courts.

Words we use

MTF Finance means Motor Trade Finance Limited, Level 1, 98 Great King St, Dunedin, New Zealand and includes any third party transferred MTF rights.

MTF Finance Group, we, us, or our means MTF Finance, MTF Finance subsidiaries and related entities, and the network of franchises and approved dealers who provide MTF Finance products and services.

You and your means our customers and other individuals who engage with us directly or indirectly.
